SPA extends by 30 days the deadline for betting ban on social welfare recipients

Normative Instruction (IN) No. 24 of the Secretariat of Prizes and Betting (SPA), published this Thursday (29), extends by 30 days the deadline for blocking beneficiaries of Bolsa Família and Benefício de Prestação Continuada (BPC) from wagering on the so-called ‘Bets’ in Brazil. The measure amends IN No. 22, which imposed the prohibition from October 30. The new date is November 30.

Normative Instruction No. 22 was issued at the end of September, requiring operators to prevent the registration or use of betting systems by beneficiaries of the Bolsa Família and the Benefício de Prestação Continuada (Continuous Cash Benefit), as well as individuals diagnosed with gambling addiction by medical report, and those prohibited from betting by administrative or judicial decision.

With the new Normative Instruction, published this Thursday (30), operators will have an additional 30 days to adapt their platforms and block the registration and use of betting systems by beneficiaries of the Bolsa Família Program and the BPC.

Betting operators must, without prejudice to other measures they deem appropriate, conduct checks through the Betting Management System (Sigap) to verify whether a user appears in the database of beneficiaries of the Bolsa Família or the BPC.

These checks must be carried out at the time a user creates an account and daily upon the first login of the day on the operator’s website.

In addition, operators must perform checks on all registered users in their betting systems through Sigap at least every fifteen days, in order to identify those who may have become beneficiaries of the social programs.

The Sigap query must be performed using the user’s CPF (Individual Taxpayer Registry) number. Sigap will return the following information to the betting operator:

- “Restricted – Social Program”, when the CPF number appears in the Restricted Module database as belonging to a person who is a beneficiary of at least one of the social programs, without specifying which one; or

- “Not Restricted”, when the CPF number does not appear in the Restricted Module database.

The registration request from a new user must be denied when the Sigap check returns the information “Restricted – Social Program.”

During the first login of the day, if the query returns the information “Restricted – Social Program,” the betting operator must close the account within three days from the date of the query.

Before closing the user’s account, the operator must notify the user of the reason, by email, messaging app, SMS, or other available means, within one day from the date of the query. The notice must inform the user that they may voluntarily withdraw any remaining funds in their account within two days.

If the user does not make the withdrawal, the operator must refund the balance to a bank account registered by the bettor. All communications with the user must be documented and stored for five years.
