For this reason, the AGU asked the Court to make it clear that the decision does not apply to fixed-odds betting— known as ‘Bets’ —a modality governed by its own regulations and currently addressed in separate cases before the STF.
The STF decision overturned federal rules that prevented companies from operating lotteries in more than one state. It also removed the ban on states advertising their lotteries outside their own territories.
If the STF concludes that bets were covered by the decision, the AGU wants that specific modality to remain subject to strict territoriality rules.
The measures proposed in the appeal, such as mandatory geolocation, would prevent a bettor from another state from using a state-level bet platform as if it were a national one.
The AGU also argued that the Court should uphold the prohibition of digital advertising for state-level ‘Bets’ outside their state of origin. The reasoning is that ads containing links effectively serve as a direct gateway for placing bets beyond state borders.
