The ruling issued a permanent ban on the use of the name “BetFla” or any symbols referring to Flamengo, with a daily fine of R$50,000 (US$9,300) in case of non-compliance, and upheld the suspension of the related domains, according to columnist Ancelmo Gois in O Globo.
The betting company was also ordered to pay R$50,000 (US$9,300) in moral damages, while compensation for material damages will be determined and calculated during the enforcement phase of the ruling.
The decision recognized unfair competition and parasitic exploitation of the club’s reputation, reaffirming the need to protect Flamengo’s brand identity against confusion and damage to its image.
Filed in 2022, the lawsuit stated that the website’s owner used Flamengo’s references to attract fans, including ads claiming to be “the betting house of the Rubro-Negro supporters.”
In August, Flamengo announced a master sponsorship agreement with Betano, worth over R$260 million (US$48.2m) per year until December 2028.
Flamengo was previously sponsored by PixBet, and had also licensed the FlaBet brand to operate alongside PixBet’s platform, aiming to strengthen its connection with Brazil’s largest fan base.
Following the end of that partnership, PixBet requested authorization from the Secretaria de Prêmios e Apostas (SPA) and changed its brand to GanheiBet, with the license granted on July 16.
