Under Normative Instruction No. 35, companies authorized to operate sports betting and online games must now notify the Secretariat of Prizes and Betting in advance, with effects only after SPA approval, in the case of changes to:
a) commercial brands, scope, and betting modalities operated by the betting operator;
b) domains; and
c) betting systems platform providers.
For these changes, operators must submit a series of documents listed in the Normative Instruction, including a specific request for the change, as well as certifications for the system to be adopted by the platform.
The following changes or actions must be communicated to the SPA and take immediate effect, without the need for prior approval:
a) financial and payment institutions authorized to operate by the Central Bank of Brazil that provide financial services to the betting operator;
b) administrators;
c) corporate name and registered office address;
d) merger, spin-off, incorporation, transformation, as well as transfer or modification of direct or indirect corporate control; and
e) the start of operations or the launch of new commercial brands by the betting operator, characterized by making offers to users through certified systems and platforms, on electronic channels under the “bet.br” domain previously authorized by the Secretariat of Prizes and Betting of the Ministry of Finance.
The measure takes effect immediately and must be adopted by betting operators whenever there is any change to the scope of the authorization granted by the Secretariat of Prizes and Betting.
