In November 2024, these actions led the STF to order the federal government to adopt immediate measures to prevent the use of funds from Bolsa Família and the Continuous Cash Benefit (BPC) in fixed-odds betting operated by private companies.
In its submission to the Court, the AGU maintained that the decision is limited to private betting platforms and does not cover federal lotteries. According to the office, the activities have different natures and are subject to distinct legal regimes.
According to the AGU, bets operated by Caixa are “occasional bets, through draws held on pre-established dates, which generate low engagement, as there is no continuous incentive.” For this reason, the ministry argued that they should not be included in the ban ordered by the STF.
The ADIs were filed by the National Confederation of Commerce (CNC) and the Solidariedade party. They challenge provisions of the legal framework that regulated the sports betting market in the country.
To comply with the STF’s preliminary ruling, the Ministry of Finance issued rules requiring private betting companies to block, based on CPF (individual taxpayer registry) data, the registration and participation of beneficiaries of social programs.
