Brazilian lawmaker introduces new proposal imposing stricter limits on ‘Bets’ advertising

Federal Deputy Luciano Ducci has introduced Constitutional Amendment Proposal (PEC) 49/2025 in the Chamber of Deputies, establishing stricter limits on advertising of the so-called ‘Bets’. The proposal requires campaigns to include clear warnings about associated risks, similar to what already applies to cigarettes, alcoholic beverages and medicines.

According to Deputy Luciano Ducci, it is essential that the betting sector be regulated with responsibility and transparency.

“Many people in vulnerable situations end up betting what little they have—their livelihood—believing in promises of quick wealth that do not reflect reality. Our role is to protect these families, ensuring that advertising is transparent and does not lead anyone to false expectations. People’s health and dignity must come before commercial interests,” he said.

The lawmaker emphasized that the proposal does not seek to ban online games or betting, but rather to address the social and public health impacts resulting from gambling advertising. The PEC paves the way for Congress to more broadly assess how to balance commercial freedom with citizen protection in the face of a rapidly expanding market.

“For me, it is essential that advertisements clearly and accurately present the nature of the product, without inducing citizens to false expectations. Advertising must reflect the reality of gambling, with its risks and possible consequences,” he added.

Support for the so-called “BETs PEC,” as the new Constitutional Amendment Proposal has been dubbed, has united lawmakers from different ideological spectrums. Deputies from both right- and left-wing parties have shown that regulating advertising for sports betting and online gaming is an issue that transcends party lines.

In total, 125 deputies have signed PEC 49/2025, the minimum number required to initiate its processing in the Chamber. The House’s Board of Directors will still issue an opinion on the procedural path to be followed.

This alignment reinforces the perception that the proposal should be discussed as a priority in Parliament, given the social and public health impacts caused by the expansion of betting platforms in the country.

Luciano Ducci highlighted the importance of this consensus. “It is very significant to see lawmakers from different parties united around this issue. It shows that protecting people from the risks of betting is not an ideological matter, but one of social responsibility and public health,” he said.
