The National Association of Municipal and State Lotteries (Analome) is closely monitoring the single-judge preliminary injunction issued by Supreme Federal Court Justice Nunes Marques on December 3, 2025, within the scope of ADPF 1212, which ordered the suspension of municipal laws establishing lotteries, as well as the interruption of currently ongoing operations in the country.
The injunction arises in a legal landscape already widely debated in the Supreme Federal Court, particularly in ADPFs 492 and 493 — cases in which a public and transparent technical understanding was established affirming that municipalities have constitutional and legal authority to operate lottery activities, provided relevant federal regulations are observed. It is based on this normative and jurisprudential framework that Analome has always guided its institutional actions, confident in the full legal viability of municipal jurisdiction to operate lotteries in a regular manner aligned with the current legal order.
In this context, the association reaffirms its full respect for judicial decisions and for the understandings consolidated by the Supreme Federal Court, noting that the preliminary injunction ad referendum is already being reviewed by the Virtual Plenary. Analome, admitted as amicus curiae in ADPF 1212, trusts that the collective review will lead to a definitive understanding, ensuring the institutional stability and legal certainty essential for federative entities, sector operators, and society as a whole.
While the injunction remains in effect, the association advises all municipalities to immediately suspend administrative and regulatory processes related to Municipal Lotteries, as well as any ongoing operations, ensuring strict compliance with the court’s order and the preservation of institutional relations.

The association will continue to cooperate with the competent authorities and contribute so that the discussion on the topic advances in a technical, balanced manner aligned with the public interest, maintaining its longstanding commitment to strengthening institutions and strictly observing the Brazilian legal framework.
