Mato Grosso do Sul reopens Lotesul bidding with corrections and new requirements

The Government of Mato Grosso do Sul has reopened the bidding process for Lotesul, with an estimated cost of R$ 51.4 million (US$9.45m), an amount corresponding to the projected revenue for operating the service. The new publication comes two months after the state requested the case be closed at the State Court of Accounts (TCE). The first call for bids, released in March of this year, faced challenges — including in the judicial sphere — due to inconsistencies.

Under the new notice, the bidding aims to hire a specialized company to implement and operate the technological platform that will control Lotesul’s lottery activities. The session for submitting proposals is scheduled for December 15.

One of the changes concerns the minimum revenue-sharing percentage the winning company must transfer to the state. In the previous notice, the rate was 16.17%; now, it has been reduced to 14.33%. The percentage of gross revenue to be transferred is one of the criteria used to evaluate and classify proposals, as Lotesul’s primary goal is to increase state revenue.

To achieve this, the state needs to contract a company responsible for developing the management platform, as well as regulating activities and payments related to lottery services operated by private agents, ensuring oversight and allowing effective supervision.

The document also highlights the need for the market to be developed in a mature manner, with “actions that inhibit and prevent misconduct by users and operators, ensuring not only the quality of services but also their security and continuity (systemic integrity).” However, it does not specify how these actions will be implemented.

Throughout the contract period, the company must carry out all updates and customizations necessary to meet state requirements. At the end of the contract, the system’s source code and proprietary information must be delivered to the government, which will then have full and unrestricted ownership of the solution. The contract term will focus on continuous development, with an emphasis on improving and evolving the systems.
