In the lawsuit, the company claims that it obtained provisional authorization from the SPA to operate fixed-odds bets using the brands ‘MetBet’, ‘Esportiva.Bet’ and ‘MetGol 100%’, exclusively for the "adaptation period", which was valid until December 31, allowing the continuity of its commercial operations during said period.
However, after this period, the company has not yet obtained the conclusion of the initial request for definitive authorization. It also informs that it fully complied with all regulatory and administrative requirements, with the presentation of all necessary documentation through Request No. 0088/2024, since December 6, 2024 and remained stagnant in the ‘Under analysis’ status by SPA/MF.
Judge Sergio Wolney de Oliveira Batista Guedes highlights in his decision that from the documents submitted in the records by the company to the SPA/MF, it is clear that there was no notification to the company, other than that sent on January 17, 2025, with the request for new documents, and it is easy to see that the administrative process was not completed (whether by approval or rejection) within the initially established deadline of December 31, 2024.
In the decision, the judge grants the injunction so that the SPA “maintains the effects of the provisional authorization in favor of the petitioner Atlantis Comércio Eletrônico e Software House Ltda so that it can operate fixed-odds bets on the domains/brands “MetBet”, “Esportiva.Bet” and “MetGol 100%”, until there is a definitive conclusion of the administrative process no. 0088/2024 or until a subsequent judicial decision to the contrary.”
