The suspension occurred because the companies failed to present technical certificates and betting systems, sports betting systems, remote gaming servers (RGS), and integration documentation issued by a certification body accredited by the SPA-MF.
Thus, Pixbet Soluções Tecnológicas – Pixbet, Flabet, and Bet da Sorte; Caixa Loterias – Betcaixa, Megabet, and Xbet Caixa; TQJ-Par (part of the Sílvio Santos Group) – Baú Bingo, Tele Sena Bet, and Bet Do Milhão; and 7MBR LTDA – Cbet will have 90 days to comply with the provisions of Ordinance SPA 2.104. Otherwise, their provisional authorizations will be revoked, and the licensing processes will be permanently archived.
The companies failed to comply with Article 3 of Ordinance SPA/MF No. 2.104, dated December 30, 2024:
“Legal entities with provisional authorization that have not submitted, in accordance with Article 14, item V, of Ordinance SPA/MF No. 827, dated May 21, 2024, the technical certificates and betting systems, Sportsbook/Remote Gaming Server (RGS), and Integration referred to in items 1, 2, and 4 of Annex VI of Ordinance SPA/MF No. 300, dated February 23, 2024, issued by a certification body whose operational capacity has been recognized by the Secretariat of Prizes and Betting of the Ministry of Finance, will have a period of thirty days from the publication of this Ordinance to submit these documents.
§1 The period referred to in the main clause may be extended once for an equal period, upon request by the provisionally authorized legal entities, duly supported by a declaration from a certification body whose operational capacity has been recognized under Ordinance MF/SPA No. 300, dated February 23, 2024, attesting to the need for additional time to conduct tests and issue the certificates referred to in items 1, 2, and 4 of Annex VI of Ordinance SPA/MF No. 300.
§2 Failure to meet the deadlines mentioned in the main clause and in §1 will result in the suspension, for up to ninety days, of the provisional authorization, during which the legal entity will be prohibited from operating fixed-odds betting without the required certification.
§3 If the certificates referred to in the main clause are not submitted within the period outlined in §2, the provisional authorization will be revoked and the administrative licensing process will be permanently archived.”
The suspension ordinance stipulates that during the suspension period, the four companies may keep their platforms online exclusively for the purpose of allowing users to withdraw funds held in their accounts.
If the companies demonstrate compliance with Article 3 of Ordinance 2.104 within 90 days, the suspensions will be lifted and the SPA will issue new, definitive authorizations.
If the suspended companies fail to submit the required documents, their provisional authorizations will be permanently revoked and their license applications archived by the Secretariat of Prizes and Betting of the Ministry of Finance.
“ORDINANCE SPA/MF No. 787, OF APRIL 10, 2025
Suspends provisional authorization for the commercial operation of the fixed-odds lottery betting modality within the national territory, for the listed legal entities.
The SECRETARY OF PRIZES AND BETTING OF THE MINISTRY OF FINANCE, in the exercise of the powers conferred by Article 55, item I, of Annex I of Decree No. 11.907, dated January 30, 2024, and in view of the provisions of Laws No. 13.756, of December 12, 2018, and No. 14.790, of December 29, 2023, and Article 3, §2, of Ordinance SPA/MF No. 2.104, of December 30, 2024, resolves:
Art. 1 This Ordinance suspends the provisional authorization granted for the commercial operation of the fixed-odds lottery betting modality within the national territory for the legal entities listed in the Annex, due to non-compliance with the provisions of Article 3 of Ordinance SPA/MF No. 2.104, of December 30, 2024.
Art. 2 The suspension provided for in this Ordinance shall last up to ninety days from the date of publication. During this time, the legal entity listed in the Annex is prohibited from operating fixed-odds lottery betting without the required certification.
Sole Paragraph. During the suspension period mentioned above, the legal entity listed in the Annex may maintain its platforms exclusively to guarantee users' rights to access and withdraw their funds.
Art. 3 Once the Secretariat of Prizes and Betting verifies compliance with Article 3 of Ordinance SPA/MF No. 2.104, within the timeframe specified in Article 2 of this Ordinance, the suspension will be lifted and a new Ordinance will be issued granting definitive authorization, in accordance with Article 10 of Ordinance SPA/MF No. 2.104.
Art. 4 If the suspension period referred to in Article 2 expires without the required certificates being submitted, as mentioned in Article 3, the provisional authorization will be revoked and the administrative authorization process of the legal entity listed in the Annex will be permanently archived, under §3 of Article 3 of Ordinance SPA/MF No. 2.104.
Art. 5 This Ordinance enters into force on the date of its publication.
