SPA defines regulatory agenda with a focus on Responsible Gaming and strengthening oversight

The Secretariat of Prizes and Betting (SPA) defined in an ordinance the regulatory agenda for the 2025/2026 biennium. The agency established the following thematic axes for the period: promotion of Responsible Gaming, prevention of pathological gambling and mitigation of externalities; promotion of a balanced, transparent regulatory environment with adequate levels of compliance; and national strengthening of regulation and oversight.

The Secretariat of Prizes and Betting (SPA) published in the Official Gazette of the Union this Wednesday (16) Ordinance 817/2025, which establishes the regulatory agenda for the 2025/2026 biennium. To implement the agenda, the SPA held a public consultation through the Participa + Brasil platform and a public hearing.

The ordinance signed by the Secretary of Prizes and Betting, Regis Dudena, reinforces that the definition of the regulatory agenda does not compromise the publication of specific or complementary regulations deemed necessary by the competent technical areas and the regulations published by other federal public bodies regarding matters within their legal and institutional jurisdictions.

The SPA defined the following thematic axes:

* Promotion of responsible gaming, prevention of pathological gambling and mitigation of externalities;

* Promotion of a balanced and transparent regulatory environment with adequate levels of compliance; and

* National strengthening of regulation and supervision.

The Annex to Ordinance 817/2025 contains the full agenda for the period:

Second quarter of 2025

1- Development and implementation of a platform, with rules for consulting and sharing data, of self-excluded bettors and those prevented from betting:

Contribute to the effectiveness of regulatory standards related to Responsible Gaming and the prevention of Pathological Gambling, provided for in Ordinance SPA/MF No. 1,231, of 2024, including respect for the autonomy of the decision to self-exclude bettors by betting operators and the list of people prohibited and prevented from betting provided for in art. 26 of Law No. 14,790, of 2023, ensuring this observance horizontally in the segment.

2- Improvement of the implementation model for the allocation of resources in exchange for the use of the image, names and sports nicknames of athletes, as well as sports symbols, anthems and other rights:

Improve the mechanism provided for in §1º-A, item III, item "a", and in §§6º and 7º, of art. 30 of Law No. 13.756, of 2018, due by betting agents for the use of image rights and similar rights to athletes and sports organizations, a model currently regulated by Ordinance SPA/MF No. 41, of 2025.

3- Definition of parameters for the creation of a distinctive seal for authorized Betting Agents:
Contribute to the adequate differentiation of regulated betting agents (authorized by SPA/MF) in relation to the irregular market, by encouraging the creation of a tokenized seal for exclusive use by betting agents.

4- Modernization of regulations and procedures related to trade promotion:

Contribute to greater effectiveness in the use of resources, efficiency and rationalization of authorization, monitoring, inspection and sanctioning procedures, related to trade promotions, including review of SEAE/ME Ordinance No. 7,638, of 2022 and assessment of a possible proposal to review Decree No. 70,951, of 1972; update procedures in light of the new structure with simplification of procedures and reduction of bureaucracy; in addition to improvements in the SCPC - Trade Promotion Control System.

5- Review of regulations on the Exclusive Instant Lottery - LOTEX:

Improve the current LOTEX model, provided for in art. 28 of Law No. 13,155, of 2015, in art. 2, Law No. 13,262 of 2016, regulated by Decree No. 9,327 of 2018 and authorized by Ordinance MF No. 1,646 of 2023.

6- Regulation of the economic chain associated with betting operators: online gaming providers and other service providers:

Contribute to the consolidation of the Brazilian betting ecosystem based on regulatory guidelines that apply vertically to service providers in addition to betting operators, contributing to greater effectiveness of domestic guidelines and greater responsiveness of the various economic agents, as well as a tool to combat illegality; an assessment is planned on:

i. online gaming providers;

ii. online gaming aggregators;

iii. gaming platform providers;

iv. odds providers;

v. live gaming studios and their equipment.

The assessment of ways to qualify suppliers is expected, with specific rules for monitoring and inspection, as well as for the eventual termination of use.

Fourth quarter of 2025

7- Establishment of a National Betting System:

Contribute to cooperative federalism and the systemic national nature of the regulation on prizes and bets, based on coordination with the States and the Federal District, the dissemination of good practices and minimum national standards for Responsible Gaming, technical requirements for systems and games, combating money laundering and other good practices.

8- Improvement of service to consumer-gamblers and family members in situations of addiction or other disorders associated with problem gambling:

Improve guidelines and rules for adequate service, by betting operators, to consumer-gamblers and family members, who are experiencing a situation of problem gambling (including addiction or related disorders). Decree No. 11,034 of 2022, which regulates the Consumer Service Department (SAC), does not sufficiently cover the particularities of the betting segment. This project aims to map the practices of the segment, discuss and identify good practices and develop a regulatory initiative, within the scope of service channels aimed at the consumer-bettor, in order to contribute to the preservation of the mental health of consumer-bettors and to the mitigation of damages associated with the activity.

First quarter of 2026

9- Consolidation and improvement of inspection procedures:

Improve procedures and standards related to the inspection of authorized betting operators and the digital environment in general (including irregular platforms).

10- Review of the authorization procedure for betting operators:

Improve the authorization application procedure, provided for in SPA/MF Ordinance No. 827, of 2024, incorporating lessons learned from the first authorization cycle.

Second quarter of 2026

11- Review of the requirements and procedures related to the recognition of the operational capacity of certifying entities:

Review of Ordinance SPA/MF No. 300, of 2024, which regulates requirements and procedures for the recognition of certifying entities of betting systems, live gaming studios and online games, to improve the regulated and balanced national betting system, with greater responsiveness and adherence to domestic regulatory guidelines in the betting certification segment (discussing, for example, the possible need for an office in the country and the presence of teams in the national territory with exclusive dedication).

Third quarter of 2026

12- Review of the regulation and implementation of procedures related to the modality of early collection of popular savings:

Modernize the procedures related to the requirement of authorization for the modality of "early collection of popular savings" provided for in art. 7th of Law No. 5,768 of 1971, introducing innovations to the model regulated by Ordinance SEAE/ME No. 7,660 of 2022, and assessing the need for a proposal to review articles 31 to 67 of Decree No. 70,951 of 1971.

Fourth quarter of 2026

13- Review of the sanctioning regime within the scope of the commercial exploitation of the fixed-odds lottery betting modality:

Improve procedures and standards (Ordinance No. 1,233 of 2024) related to sanctions for violations of the legislation on the fixed-odds lottery betting modality.
