The meeting to vote on the final report by Senator Soraya Thronicke is scheduled for this Thursday (12) at 9 a.m. The 541-page document suggests 20 measures to contain the growth of the sector, bans online casino games, criminalizes “predatory” advertising, grants more powers to Anatel, and proposes an annual adjustment of the concession fee.
Senator Ângelo Coronel requested a review, and the CPI president, Senator Dr. Hiran, suspended Tuesday’s (10) session so that the parliamentarian — who was the rapporteur of Bill 14.790 — could review the document presented by Soraya Thronicke. Since the CPI of ‘Bets’ ends on June 14, if the report is not voted on, the Commission will conclude without reaching a decision.
The report is also expected to include some suggestions presented by Senator Izalci Lucas in a separate vote, which also proposes restrictions on 'Bets’.
20 measures
In her report, Senator Soraya Thronicke presented 20 restrictive measures targeting the sports betting and online gaming industry, including a proposal to end the offering of online casino games. For each of the measures, the rapporteur outlines the concept and provides justification for the recommendation. The measures are:
1. Make it explicit in Law No. 14.790/2023 that public health takes precedence over economic interests
2. Prohibit the operation of online casinos
3. Prohibit the granting of tax incentives to betting companies
4. Limit the operating hours of online casinos
5. Create a criminal offense for unauthorized betting operators
6. Create a criminal offense for payments to unauthorized agents
7. Criminalize predatory advertising of betting services
8. Ban “others’ misfortune” clauses in advertising contracts with betting platforms
9. Prohibit promotions, rewards, or loyalty programs
10. Create the Fund to Combat Illegal Betting Platforms
11. Grant Anatel the power to block illegal betting platforms
12. Impose minimum cadence and ban acceleration features
13. Ensure transparency for time and loss control
14. Prohibit participation by individuals registered in CadÚnico
15. Create the National Betting Registry (CNA)
16. Annual adjustment of the concession fee
17. Withholding of Income Tax at the source and monthly tax reporting
18. Implement control mechanisms through financial institutions and entities authorized by the Central Bank
19. Require operators to provide educational resources on gambling risks
20. Propose the creation of the National Platform for Auditing and Monitoring Games of Chance (PNAMJA)
The report proposes the indictment of influencers such as Virgínia Fonseca and Deolane Bezerra, as well as entrepreneurs and companies that provide services to the sports betting and online gaming industry.
The senator also included in her report 17 bills aimed at “curbing the uncontrolled growth of online betting.”
Among the proposals are the prohibition of online casino games, protection of public health and gamblers, criminalization of irregular activities under Law 14.790 and related bills, as well as restrictions on sports betting advertising and limited hours for offering and operating sports betting.
