“In this case, it is not up to the Judiciary to replace the Prize and Betting Secretariat to determine the issuance of authorization, as this would imply undue interference in the administrative process,” says the judge in his decision.
Zona de Jogo filed a Writ of Mandamus against SPA in December 2024, requesting the use of a R$30 million (US$5.4m) court deposit recognized as payment for the grant, the publication of an Ordinance authorizing the exploration of sports betting and online games for 5 years and the issuance of the company’s “bet.br” domain registrations.
The preliminary decision with the authorization was issued in January of this year and the company entered the list of bets authorized to operate by court order.
The Union filed an appeal against the preliminary injunction, but the Regional Federal Court of the 1st Region denied the appeal. Zona de Jogo claimed that the preliminary injunction was not being complied with. The last step in the procedural monitoring in the 4th Federal Civil Court of the Judicial Section of the Federal District was on May 29, with the decision to suspend bet's activity.
On the website of the Secretariat of Prizes and Betting, Zona de Jogo was no longer on the list of companies authorized by court order.
