ANJL: excessive taxation of the betting sector could make operations in Brazil unviable

The six-percentage-point increase in the tax rate on GGR (Gross Gaming Revenue) for bookmakers, as stipulated in Provisional Measure 1,303, could make operations in Brazil unviable. This was the warning issued by the president of the National Association of Games and Lotteries (ANJL), Plínio Lemos Jorge, during the Bet Summit this week in Brasília.

"At this point in the regulatory landscape, we have many issues. They're all significant. But right now, our biggest concern is this Provisional Measure. We conducted a study that showed that, in this scenario, no business can sustain itself. Some businesses won't be able to handle this tax burden and will seek alternatives elsewhere," said Plínio Lemos Jorge.

The ANJL president was one of the speakers on the panel "Taxation in the Betting Sector: Balancing Competitiveness and Compliance," alongside Tax Law professor Ana Helena Pamplona and tax attorneys Paulo Horn and João Paulo Todde.

Everyone unanimously agreed that, despite the successful regulation of the sector, the betting industry faces an uncertain scenario, with significant legal uncertainty for operators due to the constant shifts in understanding by all three branches of government.

Plínio drew attention to the fact that tax increases could frustrate the revenues estimated by the federal government, due to companies' withdrawal.

"When taxation ceases to be advantageous, instead of increasing revenue, it starts to decline. Why? Because we're leaving our homes. Those who applied for leave won't stay in Brazil. And illegal activity is taking over. In other words, I become less competitive. And this disrupts the market," Plínio added.
