In the text of the Bill approved by the City Council, “all lottery types provided for in federal law are considered lottery types.”
The first lottery type provided for in federal law is the one that distributes prizes through raffles. This is the type operated by Caixa Econômica Federal, with the raffles for the Federal Lottery, Mega Sena, Quina, Dupla Sena and other options available. In 2018, the possibility of lotteries based on fixed-odds bets was added.
Thus, according to the text of the law, it is possible for the Municipal Lottery in Guarulhos to have both a raffle system and a sports betting system. It will now be up to the city government, through the future Revenue Department, to define the lottery types that will be adopted.
According to the Bill, the Guarulhos Lottery service “will be operated by the Executive Branch, through the municipal agency responsible for revenue.”
With the restructuring of the Executive Branch of Guarulhos, this agency should be the Municipal Revenue Department. The Finance Department will be divided into the Finance and Revenue Departments.
The text also states that "the municipal body may operate the lottery directly or indirectly, through concession, permission or authorization, preceded by bidding or direct contracting, in the cases permitted by law.”
In other words, the operation may be transferred to a private company. Both the raffle and fixed-odds types. Therefore, there is nothing to prevent the service from being transferred to one of the companies that have federal authorization to operate fix-odd bets.
According to the text of the bill, in its article 5, the operator of the lottery service must comply with the obligations prescribed in federal laws “to prevent money laundering and financing of terrorism.”
After the prizes have been paid and the income tax due has been paid, the balance resulting from the collection will be transferred to the Municipality of Guarulhos, including the value of the variable grant intended to cover the costs of municipal social security and public welfare policies in the areas of human rights, sports, culture, health, public safety and urban mobility.
The division of this value between these areas will still be defined by the city government, according to the text of the law. Including in relation to the portion that will go to the company that eventually takes over the operation of the lottery service.
