ANJL statement
"The National Association of Games and Lotteries (ANJL) publicly clarifies that the statements made by the Public Defender’s Office of the State of Rio de Janeiro in the Public Civil Action (PCA) filed against 43 betting companies operating legally in the country are not accurate. Furthermore, the association warns that the initiative of the Consumer Defense Unit (Nudecon) may negatively impact bettors by fueling confusion between licensed and unlicensed operators.
It is untrue that the responsible gaming warnings are merely ‘decorative expressions’ on websites and apps. Equally inaccurate are the claims that there are no advertising limitations or that marketing campaigns promote the notion that betting is a reliable and legitimate source of income.
The betting companies targeted by the PCA have actively worked to educate consumers through their representative bodies, such as the ANJL, and have committed to responsible advertising practices. One example is the working group established by the National Council for Advertising Self-Regulation (Conar) – which included ANJL’s participation – to define ethical guidelines for betting ads back in 2023, even before the market’s official regulation under the Secretariat of Prizes and Betting (SPA), part of the Ministry of Finance.
As a result of this collective effort, in January 2024 Conar published Annex “X” of the Brazilian Code of Advertising Self-Regulation, setting standards for betting advertisements in Brazil. Among its key principles are the protection of children and adolescents, and social responsibility, including warnings about potential financial and psychological harm.
ANJL regrets that, once again, the legal and regulated betting industry is the target of hasty and technically ungrounded initiatives that only serve to strengthen the illegal market — which, unlike regulated operators, has no concern for bettors’ rights and well-being. “All necessary measures for responsible and transparent advertising have already been adopted by licensed operators. Therefore, the claims made by the Public Defender's Office do not apply to the regulated market. That is why ANJL will work to provide the necessary clarifications in court,” said ANJL President Plínio Lemos Jorge.
