STJ denies Bruno Henrique's habeas corpus and maintains investigation into sports betting fraud

Brazil’s Superior Court of Justice (STJ) denied the habeas corpus filed by the defense of Flamengo forward Bruno Henrique in a case investigating alleged sports fraud involving match-fixing to benefit bettors. The decision was signed by Justice Joel Ilan Paciornik and published this Monday (21). If sentenced to the maximum penalty, the player could face up to 17 years and eight months in prison.

Bruno Henrique is accused of forcing a yellow card during a match against Santos, part of the 2023 Brazilian Championship, in order to benefit bettors. The case is being handled by the 7th Criminal Court of Brasília, which will continue to handle the case after the STJ refused to transfer the trial to the Federal Court, as requested by the player's defense.

In the appeal, the defense requested the annulment of all procedural acts carried out to date, alleging that the Criminal Court of the Federal District lacked jurisdiction to hear the case. The reporting justice, however, emphasized that habeas corpus is not the appropriate instrument to discuss judicial jurisdiction, especially without in-depth debate in the lower courts.

In addition to Bruno Henrique, eight other people, including his brother Wander Nunes Pinto Júnior, were also indicted by the Public Prosecutor's Office of the Federal District (MP-DF) in May of this year for the same crimes.

The player had already been indicted by the Federal Police in April for sharing advance information about the yellow card. If convicted of the maximum penalty, Bruno Henrique could face up to 17 years and eight months in prison.

The investigation remains ongoing in the Federal District Court, with the case proceeding normally in the 7th Criminal Court of Brasília.
