In the ADPF, the party claims that it is unconstitutional for municipalities to operate lotteries. Justice Nunes Marques is the reporting judge on the case. However, according to Jéssica, no opinions have been issued yet. Jéssica also reported that the Attorney General's Office (AGU) agreed with Solidariedade's request. The text is currently being analyzed by the Attorney General's Office (PGR).
"If we move forward with the studies to submit the concession, the Supreme Federal Court (STF) may eventually issue a decision stating that municipalities are no longer allowed to operate them. So, we're waiting to see what happens," Jéssica Marchioretto states.
The Caxias do Sul municipal lottery was announced in December 2022, after Mayor Adiló Didomenico signed the bill, authored by the Executive Branch and unanimously approved by the City Council, which establishes the activity. The bill was based on a decision by the Supreme Court itself, from 2020, which removed the Union's exclusivity in the operation of lotteries.
Last year, the city government received a Private Interest Expression (MIP) for administration of the service. This mechanism, established by law, allows companies or individuals to submit projects of public interest for evaluation by the administration.
If the studies are successful and the municipal lottery is implemented, part of the funds received from the concession will be allocated to the Social Assistance Foundation (FAS).
