Brazilian Senate may vote today on legalization of land-based gambling in the country

The bill that authorizes the operation of casinos and bingo halls, legalizes jogo do bicho and allows betting on horse racing is one of the five items on the agenda for today's (8) Senate session, which begins at 2:00 p.m. Bill 2,234/2022 has already been approved in the Deputies Chamber in 2022 and in the Senate's Constitution and Justice Committee (CCJ) was approved in June 2024, with Senator Irajá as rapporteur. He accepted suggested amendments and promised adjustments.

Casinos

According to Bill 2.234/2022, casinos will be authorized to operate in tourist hubs or integrated leisure complexes—namely, high-end resorts and hotels with at least 100 rooms, as well as restaurants, bars, and venues for meetings and cultural events.

An amendment from Senator Angelo Coronel (PSD-BA) states that casinos must be located in integrated leisure complexes or vessels specifically designated for that purpose. There will be a limit of one casino per state and in the Federal District, except for São Paulo, which may have up to three casinos, and Minas Gerais, Rio de Janeiro, Amazonas, and Pará, which may each have up to two due to population size or territorial area.

Casinos may also be installed on maritime vessels (with a national limit of ten) and riverboats with at least 50 rooms, within the following parameters: one casino on rivers measuring between 1,500 and 2,500 km; two on rivers between 2,500 and 3,500 km; and three on rivers over 3,500 km long.

Bingo

Bingo may be operated permanently in specific venues, in traditional paper card format as well as in electronic and video bingo formats. Each municipality will be allowed one bingo hall, with larger cities permitted one for every 150,000 inhabitants.

Municipalities and the Federal District may also operate bingo games in stadiums with a minimum capacity of 15,000 spectators, provided they are not run on a temporary basis.
Bingo halls will be authorized for an initial period of 25 years, renewable for the same period. To apply for a license, companies must prove a minimum paid-in capital of R$10 million (US$ 1.8m).

Jogo do bicho

In each state and in the Federal District, one legal entity per 700,000 inhabitants may be licensed to operate jogo do bicho. In Roraima (the only state with a population below this threshold according to the 2022 Census), one operator will be permitted.

Legal entities may be authorized to operate jogo do bicho for 25 years, renewable for the same term. To apply, they must prove a minimum paid-in capital of R$10 million (US$ 1.8m)

Betting on horse races may be operated by turf organizations accredited by the Ministry of Agriculture. These same entities may also be authorized to operate bingo and video bingo games, provided they are located at the same venue where horse racing is held.

Slot machines

The bill also regulates the rental of betting machines and mandates that all such equipment be registered with public authorities and undergo regular audits.
Slot machines must be operated under a revenue-sharing model: 40% for the leasing company and 60% for the bingo hall or casino, calculated from gross revenue (total bets placed minus prizes paid).
