SPA and Brazilian states define joint self-exclusion program and unified operator disclosure

The Secretariat of Prizes and Betting (SPA) and state entities held another meeting last Friday (8) to implement the National Betting System (Sinapo). They discussed how entities will adhere and that they must comply with some rules still in the final stages of development. The self-exclusion program will be joint, as will the disclosure of authorized operators locally and throughout Brazil.

The meeting between the Secretariat of Prizes and Betting (SPA) and state entities that operate or have already approved laws to participate in the sports betting and online gaming market advanced with two initiatives that will move forward the implementation of the National Betting System (Sinapo).

During the meeting, the states were presented with a framework for how adherence to the system will take place, which will be implemented in two categories: Adhering Member and Associated Member, each with its own characteristics, particularly depending on whether the entities are already operating or have only approved legislation to do so.
 


The draft Technical Cooperation Agreement (ACT) between the SPA and the states is currently in the ministry’s legal department for the definition of some criteria regarding the entities’ adherence to the National Betting System. It should be presented at the next group meeting.

One of the topics that moved forward was the creation of a joint, centralized, public, and free self-exclusion platform. It will be developed by Serpro and will allow any Brazilian citizen to voluntarily request the blocking of access to all platforms authorized by the SPA or by the states.

Among other measures, when registering for the self-exclusion program, the bettor will stop receiving marketing, advertising, and promotional communications from betting companies regulated by the federal government or by the states.

The group also decided that the SPA’s list of authorized operators will include those licensed at the state level, with the publication of a consolidated list.

Among the advantages, the group highlighted:

- Greater ease in opening and maintaining transactional or proprietary accounts for state-licensed betting operators

- Greater ease in advertising, especially on social media

- Greater ease in making apps available in app stores

- Authorized domains less susceptible to blocking by Anatel

- Reduced legal uncertainty and greater attractiveness of licensing processes conducted by the states and the Federal District

The unified publication of state-authorized operators by the SPA will require that the entity has joined Sinapo and that the licensing process ensures the operator has implemented Responsible Gaming policies and anti-money laundering measures.

In addition, they must demonstrate measures to ensure geolocation, technical certification of betting systems, and membership in sports integrity organizations.
