According to Camiletti, the initiative aims to regulate a service that is already operating irregularly in the municipality. “There are currently establishments offering this type of activity without any authorization. The idea is that these same services be provided directly by the city’s official lottery,” the mayor said.
The bill allows the operation to be conducted directly by the Executive Branch or through accreditation, concession, public-private partnerships, or service contracts, always through public bidding and with the possibility of company consortia.
Revenue generated will be allocated to prize payments, income tax on winnings, lottery operations maintenance, and investments in health, education, culture, sports, tourism, public safety, and social assistance.
The proposal also establishes the adoption of security measures to prevent fraud and tampering, with the Municipal Secretariat of Taxes and Revenue responsible for regulation and oversight of the service.
In the bill’s justification, the mayor cites Supreme Federal Court (STF) decisions recognizing the legality of state and municipal lotteries, mentioning two ongoing Actions for Non-Compliance with a Fundamental Precept (ADPFs). One of them, ADPF 1212, filed by the Solidariedade party in March this year, challenges laws authorizing municipal lotteries and their own drawing or betting systems.
