The implementation of the list is being carried out by the SPA in cooperation with state entities participating in the Task Force for the creation of SINAPO. The register of prohibited individuals will be made available to licensed operators in Brazil as well as to state lotteries that have regulated the activity locally.
All legal ‘Bets’ will be obliged to reject new registrations, deposits, or wagers from listed users. Companies must also block accounts and return funds belonging to those identified in the restricted register.
The SPA’s list will include:
*Bolsa Família beneficiaries;
*Beneficiaries of the Continuous Benefit Program (BPC);
*Minors under 18;
*Public agents working in the betting sector;
*Professional athletes, referees, directors, inspectors, or sports coaches;
*Individuals diagnosed with gambling addiction (ludopathy);
*People who have self-excluded from betting websites;
*Users prohibited from betting by a specific court ruling.
Sports betting and online gaming companies have already expressed support for banning Bolsa Família and BPC beneficiaries from betting. However, they admit the rule is difficult to enforce unless the government creates a unified registry with up-to-date information on these individuals.
The ‘Bets’ have already implemented robust KYC processes on their platforms, requiring verification with official photo ID and facial recognition, which effectively prevents minors from wagering. Preventing beneficiaries of social programs from gambling, however, will depend on how the government provides and integrates this data.
Similarly, identifying public agents, athletes, and other individuals legally prohibited from gambling will depend on the government building a system with accurate and complete records, in order to avoid wrongful blocking of individuals with identical names (homonyms) who are legally allowed to place bets on the ‘Bets’.
