House Committee approves new rules to prevent use of lottery games in money laundering

The Finance and Taxation Committee of Brazil’s Chamber of Deputies approved a bill requiring companies that distribute money or products through lotteries or raffles to keep records of prizes paid above the income tax exemption threshold. The goal is to prevent money laundering or the concealment of assets, rights, and valuables. The committee accepted a substitute bill proposed by rapporteur Representative Florentino Neto for proyects 7684/17 and 232/03.

The registration must contain the winner's information (name, identification document, CPF), prize details (type of lottery, draw date, amount, description, and payment method), and payer information (company name, CNPJ, addresses, and identification of responsible parties).

Companies must retain this information for at least five years after the prize is delivered or paid.

The approved text guarantees the anonymity of the winner of any federal or state lottery, regardless of the prize amount. Furthermore, it prohibits the use of the winner's name or image in advertising without their express consent. Any requirement on lottery tickets that obligates the winner to participate in advertising to receive the prize will be considered void.

"The implementation of more specific rules is combined with regulatory precautions aimed at protecting the lottery and sweepstakes system from illicit use, without compromising its normal operation and the experience of legitimate users," argues the rapporteur.

Florentino Neto opposed proposals that would require bettors to be identified by their CPF (Individual Taxpayer Registry) at the time of placing a bet, or that would require the disclosure of information about winners.

The proposal will be reviewed conclusively by the Committee on Constitution, Justice, and Citizenship. It will then proceed to the plenary session. To become law, the bill must be approved by both the Chamber of Deputies and the Senate.
