São Paulo Court halts state lottery concession after objection from Aposta Vencedora Consortium

The São Paulo State Court of Auditors (TCE-SP) has ordered the temporary suspension of administrative actions related to the concession of state lotteries. The decision was made by Substitute Councilor-Auditor Samy Wurman, after the Aposta Vencedora Consortium filed a complaint against the way the bidding process has been conducted. The Secretariat of Partnerships and Investments (SPI) will have five days to provide explanations on the points raised.

The dispute over the exploitation of lottery services began in October 2024, with the participation of two groups: the Aposta Vencedora Consortium, formed by SAV Participações and AX4B Sistemas, and the SP Loterias Consortium, led by IGT Global Services in partnership with Scientific Games.

The public notice established a 15-year contract, required minimum investments of R$ 333 million (US$63m), and set the selection criterion as the highest fixed grant offered to the State, with a minimum threshold of R$ 260.7 million (US$49m).

In the auction held in November 2024, the Aposta Vencedora Consortium outbid its rival by offering an initial grant of R$ 600 million (US$113m) —130% above the minimum required. However, in May 2025, the group failed to make the payment and was disqualified. SPI then summoned the SP Loterias Consortium, whose proposal amounted to R$ 526.5 million (US$99m).

Dissatisfied, the Aposta Vencedora Consortium sought to overturn the administrative decision and also appealed to the Judiciary but was unsuccessful in obtaining injunctions. Now, before TCE-SP, the consortium alleges irregularities in the competitor’s qualification, such as issues with performance bond policies and alleged inconsistencies in documents from foreign companies within the group.

According to the filing, approval of the rival proposal could cause an estimated loss of around R$ 80 million to the public coffers.

Based on these allegations, the Court of Accounts determined that SPI must not sign the contract until a new decision is made. The precautionary measure seeks to ensure legality, transparency, and the public interest before the process continues. After the Secretariat presents its justifications, the case will return for further review by Counselor Wurman.

Prior to the suspension, SPI had already published, in June, the minutes declaring the SP Loterias Consortium (formed by IGT Global Services and Scientific Games) as the winner and qualified. The project foresees not only 31 exclusive physical outlets, but also the installation of up to 11,000 non-exclusive points of sale and the possibility of digital operation throughout the state of São Paulo.
