SPA, Anatel, and ANJL sign technical agreement to block illegal 'Bets'

The Secretariat of Prizes and Betting (SPA), the National Telecommunications Agency (Anatel), and the National Association of Games and Lotteries (ANJL) signed this Thursday (25) a cooperation agreement to strengthen actions aimed at blocking illegal betting sites in Brazil. The partnership includes the creation of both a virtual and a physical laboratory to provide Anatel with high-performance technical resources and to support analyses of equipment.


Through the agreement, ANJL will support the implementation of a cyber laboratory, which will be structured to provide Anatel with high-performance technical resources. The goal is to ensure greater speed and reliability in executing the blocking of irregular websites, always in accordance with the determinations issued by SPA.

The initiative reinforces the joint commitment of the institutions to ensure the integrity of the betting market, protect consumers, and guarantee compliance with current legislation. The new laboratory environment will allow blockings to be carried out more swiftly, transparently, and with stronger technical robustness, strengthening regulatory and supervisory efforts.

Currently, Anatel and SPA have a Technical Cooperation Agreement – ACT MF No. 45/2024, established to expedite and optimize the blocking of websites that illegally offer fixed-odds bets, through a fast and direct flow of information between the institutions.

The president of Anatel, Carlos Baigorri, highlighted the importance of the measure: “Combating illegal 'Bets' requires a joint effort from public authorities and the regulated sector. It is essential to create effective technological barriers, but also to raise awareness among people not to gamble on irregular platforms. This agreement is a decisive step in that direction.

The Secretary of Prizes and Betting, Régis Dudena, emphasized that the partnership with ANJL reinforces the convergence of interests between the State and the regulated sector: “Confronting illegal bets is a priority. Having the support of a representative entity such as the National Association of Games and Lotteries is key to strengthening Anatel’s actions and ensuring a more integral and fair market.

Anatel’s board member, Edson de Holanda, pointed out that bringing activities that were previously on the margins of legality into the regulatory framework also means expanding benefits for society:
This is not only about combating illegality from a criminal perspective, but also about allowing the resources generated by this activity to be returned in the form of taxation and public policies.”

ANJL’s Legal Director, Pietro Cardia Lorenzoni, reinforced the entity’s commitment to collaborating with public authorities: “Our association is guided by the principle of supporting the authorities in structuring the regulated sector, bringing best practices. Anatel’s experience in combating piracy is a benchmark, and we want to contribute effectively to this effort.

According to Anatel’s Superintendent of Supervision, Gesiléa Teles, “the new Cooperation Agreement is an advancement in this integration, as it aims to improve the technical capacity of the agencies involved in combating irregularities related to fixed-odds bets, ensuring stronger oversight of the sector.”

The Cooperation Agreement has as its objective, according to the specifications established in the Work Plan:

I – The structuring, by ANJL, of a virtual laboratory for SPA and Anatel to:
 

  1. carry out technical analyses for blocking websites that do not comply with legal and regulatory requirements established by SPA;

  2. identify internet routes for activities of interest to SPA and Anatel;

  3. conduct studies on cyber vulnerabilities and irregular practices by authorized or unauthorized telecommunications service providers;

  4. perform technical analyses for blocking websites and applications subject to judicial or administrative orders for offering fixed-odds betting modalities in violation of the law;

  5. develop studies on best techniques for blocking websites and applications;

  6. manage the issuance, to telecommunications service providers, of blocking orders for websites and applications subject to judicial or administrative orders; and

  7. monitor compliance, by telecommunications service providers, with blocking orders for websites and applications subject to judicial or administrative orders for offering fixed-odds betting modalities in violation of the law.
     

II – The structuring, by ANJL, of a physical laboratory at Anatel’s facilities, with access granted to SPA, equipped with sufficient technological resources to:
 

  1. perform and monitor technical analyses on equipment and illegal means of offering fixed-odds betting lotteries;

  2. guide and conduct analyses on cyber vulnerabilities in equipment and illegal means of offering fixed-odds betting lotteries;

  3. conduct studies related to the use of equipment and illegal means of offering fixed-odds betting lotteries; and

  4. carry out analyses and studies, with possible subsequent disclosure, in compliance with the legal and regulatory confidentiality rules for information.
     

The agreement is valid for 36 months from the date of its signing and may be extended according to the needs of the parties involved.
